ICAS 2023 SOCIAL MEDIA COMPETITION – GAME OF SKILL

The Promoter is Janison Solutions Pty Ltd (ABN 35 081 897 494) C/ Automic Group, of Level 5, 126 Phillip Street, Sydney NSW 2000, Australia (we, us, Janison) trading as ICAS Assessments

Entry for the ICAS 2023 Social Media Competition (Competition) is open to Australian and New Zealand residents aged 18 years and over that are the parents and/or legal guardians of a child that participated in ICAS 2023.

The Competition commences at 12:01am AEST on Monday, 23 October 2023 and closes at 11:59pm AEST on Friday, 1 December 2023.

We are offering twenty individual one-hundred-dollar ($100) prizes for each prize winner [total prize pool $2,000], that will be paid by VISA gift card to the Winner (in the Winner’s local currency AUD or NZD). The Prize is not transferable and not redeemable for cash.

To enter, you must complete these three steps:

1) Post a video of your child on Facebook or Instagram, telling us what they enjoyed most about competing in ICAS 2023 while proudly holding their ICAS certificate and/or medal. Video length must be 15 seconds or less, OR;

Alternatively, you can post a photo of your child proudly holding their ICAS certificate and/or medal on Facebook or Instagram and tell us (in your child’s words) what they enjoyed most about competing in ICAS 2023 in the post caption (in 50 words or less).

2) Use #ICAS2023 in your post caption.

3) Follow the ICAS Assessments Facebook page, found at facebook.com/ICASAssessments.

Facebook posts and Instagram profiles must be publicly visible for the duration of the competition for the entry to be valid. Individuals can enter multiple times.

The twenty (20) most captivating, original and creative entries with corresponding good-quality (resolution, composition) photos and videos will win a Prize.

By entering you acknowledge that your entry content may be used for the purpose of promotion and marketing of ICAS Assessments.

Judging will take place at 1pm AEST on Tuesday, 5 December 2023 at Level 1, 80 Bay Street, Ultimo NSW 2007. The Winners will be notified in writing by private message to the Facebook or Instagram account used to enter the Competition, within 7 days of the Judging Date and Time. ICAS 2023 SOCIAL MEDIA COMPETITION – Terms and Conditions:

1. Acceptance

Information on how to enter and prizes form part of these Terms and Conditions. By participating, entrants agree to be bound by these Terms and Conditions. Entries must comply with these Terms and Conditions to be valid.

2. Promoter

The Promoter is Janison Solutions Pty Ltd (ABN 35 081 897 494) of Level 1, 80 Bay Street, Ultimo NSW 2007 (we, us, Janison) trading as ICAS Assessments.

3. Competition period

The Competition commences on Monday, 23 October 2023 at 12:01am (AEST) and concludes on Friday, 1 December 2023 at 11.59pm (AEST) (Competition Period).

4. Eligibility to enter

Entry is open to Australian and New Zealand residents aged 18 years and over that are the parents and/or legal guardians of a child that participated in ICAS 2023. (Eligible Entrants). Directors, management, employees and their immediate families, of the Promoter are ineligible to enter. By entering you acknowledge that your entry content may be used for the purpose of promotion and marketing of ICAS assessments (see clauses 12 – 15).

5.How to enter

To enter, Eligible Entrants must, during the Competition Period:

 1) Post a video of your child on Facebook or Instagram, telling us what they enjoyed most about competing in ICAS 2023 while proudly holding their ICAS certificate and/or medal. Video length must be 15 seconds or less; OR.

Alternatively, you can post a photo of your child proudly holding their ICAS certificate and/or medal on Facebook or Instagram and tell us (in your child’s words) what they enjoyed most about competing in ICAS 2023 in the post caption (in 50 words or less)

2) Use #ICAS2023 in your post caption.

6. Prizes

There are twenty (20) prizes of one-hundred dollars ($100) each that will be paid by VISA gift card to the Winners’ in the Winner’s local currency (AUD or NZD) (Prize).

7. Judging Date and Time

Judging will take place at 1pm AEST on Tuesday, 5 December 2023 at Level 1, 80 Bay Street, Ultimo NSW 2007 (Judging Date and Time). All entries will be judged by a panel of three qualified judges individually on their merits based on captivation, originality and creativity of responses with corresponding good-quality photo or video (resolution, composition). The twenty (20) best entries as determined by the judges in their absolute discretion will win a one-hundred-dollar ($100) VISA gift card Prize. This is a game of skill and chance plays no part in determining the winner.

8. Prize delivery

Prizes will be delivered to the Winners within 28 days after the Judging Date in the Winners’ local currency (AUD or NZD). The Winners will be notified about how the Prize will be delivered (or may be collected) within 7 days of the Judging Date and Time.

9. Winner notification and publication

The Winners will be notified within seven (7) days of the Judging Date and Time. The Winners will be notified in writing by private message to the Facebook or Instagram account used to enter the Competition.

10. Unclaimed prizes

If a Prize is not accepted or claimed within seven (7) days of the Judging Date and Time, the relevant winner’s entry will be deemed invalid and the Promoter will distribute any unclaimed Prizes to the next best ranking entry or entries (as applicable), as determined by the judges or the Promoter in its absolute discretion.

11. Use of Eligible Entrant’s personal information

a) Personal information included in the Eligible Entrant’s submission (including but not limited to social media handle/name and photo with question response and/or video of child) will be collected and used for the purpose of conducting this Competition and may be used for promotional and marketing purposes including but not limited to on Janison’s website, LinkedIn and social media platforms and may require disclosure to third parties, including local regulatory authorities and the Promoter’s agents or third-party service providers, for the purpose of conducting the Competition, or for promotional and marketing purposes (including for direct marketing) (Purpose).

b) As submissions include videos and/or photographs of children you warrant that you i) have the child’s consent to provide their personal information and that ii) if the child is under 18, you are the child’s parent and/or legal guardian and you consent to their personal information being disclosed to Janison and that iii) Janison may use the personal information for the Purpose.

c) Winners will also be required to provide their full name, mobile number, physical address and email address. Winner’s names and entry submissions may be publicised.

d) Eligible Entrants may access, change or update their personal information by contacting the Promoter via this contact us form or by telephone on 1800 931 775 (Australia toll-free) or 0800 440 904 (New Zealand toll-free) during office hours. A copy of the Promoter’s privacy policy is available at janison.com/privacy-policy. The privacy policy contains information about how individuals may access or correct personal information or make a privacy related complaint.

12. Entry content

a) Entries must be the Eligible Entrant’s original work. The Promoter reserves the right to require the Eligible Entrant to verify that the entry is the Eligible Entrant’s original work. If the Promoter is unable to verify that the entry is original work to its satisfaction, the entry will be deemed invalid.

b) Eligible Entrants warrant that their entry is not in breach of any third-party intellectual property rights. Eligible Entrants agree to indemnify the Promoter and its associated agencies against all losses, damages, claims and costs by third parties arising out of, connected to, or resulting from, a breach of this warranty.

c) An Eligible Entrant’s entry must not include any image, video or voice of any other person without that person’s express consent (or if a child under 18, the express consent of the child’s parent and/or legal guardian) or any content that contravenes any law.

13. Intellectual property and moral rights

‌a) By entering this Competition, Eligible Entrants grant the Promoter a non-exclusive, non-revocable worldwide licence to use the content of their entry, or any part of the content of the entry, in any way the Promoter wishes (including modifying, adapting, copying, cropping, retouching, editing, publishing, broadcasting or communicating the entry whether in original or modified form in whole or in part) in all media (including online social media) for the purposes of the Promoter’s business and marketing on its website, social media or in any marketing campaign, without payment to the Eligible Entrant of royalties or compensation. If requested by the Promoter, Eligible Entrants agree to sign any further documentation required by the Promoter to give effect to this clause.

b) By entering this Competition, Eligible Entrants consent to the Promoter dealing with their entry content in any way that may otherwise infringe the Eligible Entrants’ moral rights and agree not to assert their moral rights (wherever such rights are recognised) in respect of their entry against the Promoter or its assigns, licensees or successors.

c) Eligible Entrants warrant that their entry is not in breach of any third-party intellectual property rights.

14. Publicity

Eligible Entrants consent to the Promoter using their name, likeness, image and/or voice in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting this Competition (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.

15. Social media platforms

By using and entering this Competition on Facebook or Instagram Eligible Entrants agree to comply with Instagram’s and Facebook’s terms of use; release Facebook and Instagram from all claims based on, related to or arising from the Competition; and acknowledge and agree that this Competition is in no way sponsored, endorsed, administered by or affiliated with Facebook or Instagram. The Promoter is not responsible for any loss, damage or injury to Eligible Entrants resulting from entering or participating in this Competition including arising from any comments made, or material published, by third parties about the Eligible Entrants on any social media platform in connection with this Competition.

16. General conditions

a) Should an Eligible Entrant’s contact details change during the Competition Period, it is the Eligible Entrant’s responsibility to notify the Promoter. A request to access or modify any information provided as part of the redemption of a Prize should be directed to the Promoter.

b) The Promoter reserves the right to request verification of the social media profile of Eligible Entrants and of the age, identity and residential address of the Winners and any other information relevant to entry into or participation in this Competition. Verification is at the discretion of the Promoter; whose decision is final. Failure by the Promoter to enforce any of its rights does not constitute a waiver of those rights.

c) The Promoter reserves the right to disqualify any individual who submits an entry that is not in accordance with these terms and conditions.

d) The Winner has rights under the Australian Consumer Law and other similar legislation which cannot be excluded, restricted or modified by the Promoter. These terms and conditions do not exclude, restrict or limit those statutory rights in any way. 

e) If for any reason beyond the reasonable control of the Promoter this Competition is not capable of running as planned, the Promoter reserves the right in its sole discretion to take any action that may be available to it, and to cancel, terminate, modify or suspend the Competition, unless to do so would be prohibited by law.

f) The Promoter reserves the right to cancel, terminate, modify or suspend the Competition or amend these terms and conditions, subject to any directions from a regulatory authority.

g) These terms and conditions are governed by the laws of New South Wales, Australia. You and we both agree that the courts in New South Wales, Australia will have exclusive jurisdiction.
